Online webinar on “Enforcement of IPR laws by Police, Best Practices and Brand Identification” for the officers undergoing training at the Rajasthan Police Academy, June 9th, 2020.

In the midst of Covid-19 outbreak, United IPR collaborated with the Rajasthan Police Academy
and conducted an online webinar on “Enforcement of IPR laws by Police, Best Practices and
Brand Identification” for the officers undergoing training at the Rajasthan Police Academy on 9th
June, 2020. The webinar was attended by more than 60 officers. It commenced with an academic
session delivered by Mr. Sudarshan Bansal, Senior Partner-United IPR, highlighting the general
concepts of IPR and the role of Police in enforcement thereof. He focused on the practice &
procedure to be followed by the Police officers while conducting search & seizure action under
the Trade Marks Act, 1999 and Copyright Act, 1957. Mr. Bansal also stressed that the menace of
counterfeiting and piracy demands a stern consideration of the enforcement agencies to build
capacity of their officials at various levels specially the IPR cells of State Police Forces.
The second session was delivered by Mr. Gaurav Gogia, Senior Associate-United IPR, who
discussed relevant notifications, case laws and other legal principles dealing with both civil and
criminal enforcement of IPR. He also shared specific guidelines to be followed by Police officers
whilst registering a complaint for IPR infringement, during a search & seizure action and how to
ensure conviction for the offenders.
The webinar also featured the participation of representatives of different right holders who
provided key inputs for identification of original and counterfeit products. This was followed by
an extensive workshop on brand identification techniques on behalf of various brands.
The Police Officers participated enthusiastically and shared constructive feedback in the question
answer session held during as well as upon the conclusion of the webinar. The closing remarks
were made by the Additional Director of the Academy Mr. Saurabh Kothari, who appreciated
this unique endeavor and encouraged similar collaborative efforts for the welfare of probationer
officers at the Rajasthan Police Academy.

This is in continuation to our Report dated May 29, 2020 on the captioned

United IPR, with the avowed objective of maintaining social distancing norms,
continued with its online training program for “Enforcement of IPR laws
and product identification of participating brands with Tughlakabad
Customs, New Delhi”.
The webinar started with a discourse on the relevant provisions pertaining to
the enforcement of IP rights by Indian Customs with a special focus on
Notification No. 47 of 2007 dated May 08, 2007 and Circular No. 41 of 2007
dated October 29, 2007 which dealt with Intellectual Property Rights
(Imported Goods) Enforcement Rules, 2007.
In addition to the relevant statutory provisions and the underlying concepts,
the webinar also included presentations on behalf of various right holders.
These presentations were aimed at sharing some of the key identification
features between genuine and counterfeit goods, discreet information
pertaining to the supply chain and the case studies of a variety of enforcement
actions undertaken by the right holders with the support of Customs
authorities across the world.
The closing remarks were made by thanking the officers of the Tughlakabad
Customs for their participation and their stalwart belief in United IPR’s efforts
to fight counterfeiting and piracy at the Indian territorial borders.

The reach of Coronavirus has been felt across all facets of life, but this has not dented the spirits
of Indian enforcement agencies in carrying out their operations against counterfeit and pirated
goods. Utilizing its vast experience on capacity-building, knowledge-sharing and imparting
personal trainings, United IPR collaborated with the Indian Customs to organize the 1st
Webinar Training on enforcement of IPR laws and product identification of participating
brands with the Tughlakabad Customs, New Delhi, on May 29, 2020 which was attended
by approximately 30 Custom officials.
The opening remarks of the Webinar were delivered by Mr. Shravan Bansal, Senior Partner –
United IPR who hailed the work done by Indian Customs, shared some of the best practices
and addressed concerns on the practical difficulties encountered during the course of
investigating an IPR infringement case. While discussing the role of Indian Customs in IPR
enforcement, emphasis was laid on the expeditious destruction process, consistency in
valuation of goods and speedy adjudication of the cases.
The opening remarks were followed by presentations on behalf of various well-known brands.
The participating right-holders shared key inputs on the distribution and supply chain of the
products in addition to some of the identification features of their products. They also conveyed
their appreciation to the Indian Customs for the proactive approach, for the cooperation
extended to the right-holders, for the suo-motu interception of consignments containing fake
goods and for continuing with the excellent work even in the present times.
The closing remarks of the webinar were made by thanking the esteemed officers of the
Tughlakabad Customs for their participation. The second part of the webinar will continue on
Monday, 1st June, 2020 where more right-holders will be participating and the relevant
Circulars and Notifications under the Customs Act will be discussed.

Mr. Gaurav Gogia, Advocate – Senior Associate at United IPR delivered a webinar on Trademark and Design laws for DST, Rajasthan on April 18, 2020. It was organized by PIC &TISC DST Rajasthan in collaboration with PFC, TIFAC and CIPAM, DPIIT Government of India and attended by more than 90 faculty members and students from various streams and disciplines.
