Online webinar on “Enforcement of IPR laws by Police, Best Practices and Brand Identification” for the officers undergoing training at the Rajasthan Police Academy, June 9th, 2020.

In the midst of Covid-19 outbreak, United IPR collaborated with the Rajasthan Police Academy
and conducted an online webinar on “Enforcement of IPR laws by Police, Best Practices and
Brand Identification” for the officers undergoing training at the Rajasthan Police Academy on 9th
June, 2020. The webinar was attended by more than 60 officers. It commenced with an academic
session delivered by Mr. Sudarshan Bansal, Senior Partner-United IPR, highlighting the general
concepts of IPR and the role of Police in enforcement thereof. He focused on the practice &
procedure to be followed by the Police officers while conducting search & seizure action under
the Trade Marks Act, 1999 and Copyright Act, 1957. Mr. Bansal also stressed that the menace of
counterfeiting and piracy demands a stern consideration of the enforcement agencies to build
capacity of their officials at various levels specially the IPR cells of State Police Forces.
The second session was delivered by Mr. Gaurav Gogia, Senior Associate-United IPR, who
discussed relevant notifications, case laws and other legal principles dealing with both civil and
criminal enforcement of IPR. He also shared specific guidelines to be followed by Police officers
whilst registering a complaint for IPR infringement, during a search & seizure action and how to
ensure conviction for the offenders.
The webinar also featured the participation of representatives of different right holders who
provided key inputs for identification of original and counterfeit products. This was followed by
an extensive workshop on brand identification techniques on behalf of various brands.
The Police Officers participated enthusiastically and shared constructive feedback in the question
answer session held during as well as upon the conclusion of the webinar. The closing remarks
were made by the Additional Director of the Academy Mr. Saurabh Kothari, who appreciated
this unique endeavor and encouraged similar collaborative efforts for the welfare of probationer
officers at the Rajasthan Police Academy.

unprecedented challenges that may be posed in the post lockdown environment.

Online workshop organized by Cell for IPR Promotion and Management (CIPAM) in collaboration with National Academy of Customs, Indirect Taxes and Narcotics (NACIN) on “Enforcement of Intellectual Property Rights by Indian Customs”, June 3rd, 2020

As India begins to navigate its transition into the ‘new normal’ with Unlock 1.0, the Indian Custom
authorities continue their relentless efforts for protecting borders from entry of infringing goods. United
IPR presented in the online workshop organized by Cell for IPR Promotion and Management (CIPAM) in
collaboration with the National Academy of Customs Indirect Tax and Narcotics (NACIN), Faridabad on
June 3, 2020 on “Enforcement of Intellectual Property Rights by Indian Customs” for the officers of Indian
Customs. The workshop was attended by 60 customs officials from different ports across the country. It
commenced with a technical session delivered by Mr. Sudarshan Kumar Bansal, Senior Partner- United
IPR who discussed on the categories of IPR’s relevant for the Indian Customs and also illustrated various
modes in which infringement occurs. Whilst recognizing the importance and role played by the Indian
Custom authorities in the robust & effective implementation of the IPR laws at the territorial borders, he
also discussed the specific practical challenges in curbing the ever-increasing market for counterfeit and
pirate goods.
The workshop continued with a session which dealt with the regulatory framework under Indian legal
regime dealing with the procedure for registration, interdiction, suspension, determination and
destruction of IPR infringing goods. The participating officers were able to learn about the best practices
followed by other custom authorities in enforcement of IP Rights, specific inputs and intelligence of
suspicious consignments, doctrine of international exhaustion and the ways to prevent the entry of grey
market goods in the country.
The technical sessions were followed by presentations on behalf of various well-known brands by their
respective representatives who participated in the workshop with the aim to equip the custom officials
with vital inputs pertaining to distribution and supply chain of original goods, tips for detecting suspicious
consignments and various methodologies to aid the officials in differentiating between original product
from counterfeit. The representatives also appreciated the Indian Customs for their continued
cooperation in enforcing IP rights.

and is proud to play a part in assisting the officers in discharging their mandate.

Mr. Gaurav Gogia, Advocate – Senior Associate at United IPR delivered a webinar on Trademark and Design laws for DST, Rajasthan on April 18, 2020. It was organized by PIC &TISC DST Rajasthan in collaboration with PFC, TIFAC and CIPAM, DPIIT Government of India and attended by more than 90 faculty members and students from various streams and disciplines.

To address the issue on ‘Impact of counterfeiting on consumers, society, economy & right-holders and the initiatives taken by the right-holders to enhance the brand’s capacity in minimizing the penetration and sale of counterfeits throughout India, United IPR organized a training for law and engineering students of Bennett University, NCR, India on 1st October, 2019.

Our Managing Associate, Mr. Rishi Bansal, in addition to the above issues, emphasized the underlying objectives of IPR Protection, perils of counterfeiting, procedure for IP protection, enforcement and prosecution and landmark cases on IPR Enforcement and Litigation.

In a seminar organized at the Faculty of Law, University of Delhi on February 19, 2020, United IPR participated as a knowledge partner. Mr. Gaurav Gogia, Advocate – Senior Associate, United IPR delivered a talk as a Session Expert sensitizing on the importance of IPR laws and on the malefic impacts of counterfeiting and piracy. United IPR takes pride to be a part of such capacity-building efforts in a pro-bono manner with an attempt to evolve and nurture an IP friendly regime in the country.

Session Expert on the various facets of Intellectual Property Rights by Mr. Gaurav Gogia, at Rani Durgavati Vishwavidyalaya, in Jabalpur, Madhya Pradesh, February 13th, 2020

Session on the brand identification techniques for various apparel and footwear brands by Mr. Dhirendra Singh, January 30th, 2020

In an IPR training organized by United IPR for the Officers from Patparganj Customs and other ICDs (under the jurisdiction of Patparganj Commissionerate) on 30th January, 2020, Mr. Dhirendra Singh, Advocate & Associate at United IPR delivered a session on the brand identification techniques for various apparel and footwear brands. While having discussion on the issues related to counterfeiting, infringement and the associated health hazards, this interactive session enlightened the Custom Officers on key identification features of the genuine products to assist them with preliminary examination while detaining the imported goods.
